    How does Nevada define a construction worker?

    Construction worker means a person who actually performs physical work at a construction site that results in the construction, alteration or destruction involved in the construction project including without limitation painting and decorating; or who supervises any person engaged in that work.

    The term does not include a person to the extent that the person performs or supervises another person who performs work which is conducted for the upkeep of an existing property for which a certificate of occupancy has been issued by the appropriate building inspector or other authority, and to prevent the property from degrading, to maintain the operational soundness of the property, including without limitation, by repairing the components of the property or by replacing components of the property with the same or similar components.

    When does a worker or supervisor have to obtain an OSHA 10 or 30 Hour card?

    Trade Show/Convention – Not later than 15 days after being hired.

    Entertainment – Not later than 15 days after being hired.

    Construction – Not later than 15 days after being hired.

    Cannabis Industry – Not later than 365 days after being hired or if already employed, on or before June 30, 2022

    Is there an expiration date for course completion cards in Nevada?

    Trade Show/Conventions – OSHA 10/30-hour cards do not have an expiration. However, for the purpose of working in the trade show/convention industry in the state of Nevada. Certain jobs require the 10 and 30 hour OSHA general industry or construction cards to be renewed or refreshed every 5 years from the date of issue. There are no refresher courses or continuing education courses approved at this time. The employees or supervisors must take the course again. For any use not specified in the NRS/NAC these federal cards do not expire.

    Construction – No. For the purpose of working on a construction site in the state of Nevada, the 10 and 30 hour construction cards do not expire. For any use not specified in the NRS/NAC these federal cards do not expire.

    Cannabis Industries – No, for the purpose of working at a cannabis establishment in the state of Nevada. The 10 and 30 hour construction cards do not expire. For any use not specified in the NRS/NAC these federal cards do not expire.

    Entertainment – OSHA 10/30-hour cards do not have an expiration. However, for the purpose of working in the entertainment industry in the state of Nevada. Certain jobs require the 10 and 30 hour OSHA general industry cards to be renewed or refreshed every 5 years from the date of issue.     What are the OSHA Outreach Training 10 & 30 Hour Construction and General Industry Programs?

    The Occupational Safety and Health Administrations (OSHA) Outreach Training Program is a program to train workers in the basics of safety and health hazard recognition and prevention and has been in existence for over 50 years. The curriculum includes 10 or 30 hours of actual classroom instruction developed by OSHA, but does not include time allotted for breaks or meals for the students.

    Does Nevada have a statute that requires certain employees engaged in construction, entertainment, trade show/conventions, and cannabis industries to have an OSHA 10 or 30 Hour Construction or General Industry Card or similar program approved by its Division of Industrial Relations?

    The Construction measure was passed by the 2009 legislature. The law became effective January 1, 2010.

    The Entertainment measure was passed by the 2017 legislature. The law became effective January 1, 2019.

    The Trade Show/Convention measure was passed by the 2019 legislature. The law became effective January 1, 2020.

    The Cannabis Industry measure was passed by the 2021 legislature. The law becomes effective January 1, 2022.
