Overview of Requirements for Construction


Why, Who, and What?

In 2009 the Nevada Legislature enacted a requirement for those persons in volved in construction to take training designed to help keep them safe from workplace illnesses and injuries on construction sites.  The training that was selected was the Occupational Safety and Health Administrations 10 and 30 Hour Construction Course.  The 10 Hour card is required for those involved in accomplishing construction activities and the 30 hour card is required for those who supervise them.

Construction worker” means a person who actually performs physical work at a construction site:
That results in the construction, alteration or destruction involved in the construction project, including, without limitation, painting and decorating; or Who supervises any person engaged in work described above

“Supervisory employee” means any person having authority in the interest of the employer to hire, transfer, suspend, lay off, recall, promote, discharge, assign, reward or discipline other employees or responsibility to direct them, to adjust their grievances or effectively to recommend such action, if in connection with the foregoing, the exercise of such authority is not of a merely routine or clerical nature but requires the use of independent judgment. The exercise of such authority shall not be deemed to place the employee in supervisory employee status unless the exercise of such authority occupies a significant portion of the employee’s workday.

Proof of Training?

If you as a worker (10-hour card) or supervisory employee (30-hour card) fails to present your employer with a current and valid completion card for an OSHA-10 or 30 hour Construction Course as required by the NRS within 15 days of hire, your employer is required to suspend or terminate your employment.  All OSHA 10 and 30 hour cards issued after 01/01/2020 in the state of Nevada are required by the NRS to be entered in to a verification data base by the trainer completing the training.  The button below will take you to the verification site.

What the Law Says

NRS 618.983  Requirements to obtain completion card.

      1.  Not later than 15 days after the date a construction worker other than a supervisory employee is hired, the construction worker must obtain a completion card for an OSHA-10 course which is issued upon completion of a course approved by the Division pursuant to NRS 618.977.

      2.  Not later than 15 days after the date a supervisory employee is hired, the supervisory employee must obtain a completion card for an OSHA-30 course which is issued upon completion of a course approved by the Division pursuant to NRS 618.977.

      NRS 618.987  Requirements to present employer with completion card.

      1.  If a construction worker other than a supervisory employee fails to present his or her employer with a current and valid completion card for an OSHA-10 course not later than 15 days after being hired, the employer shall suspend or terminate his or her employment.

      2.  If a supervisory employee on a construction site fails to present his or her employer with a current and valid completion card for an OSHA-30 course not later than 15 days after being hired, the employer shall suspend or terminate his or her employment.

Construction Industry Requirements

The Nevada Revised Standards (NRS) require:
Not later than 15 days after the date a construction worker (10-hour card) or supervisory employee (30-hour card) is hired, the construction worker must obtain a completion card for an OSHA-10 or 30 hour course which is issued upon completion of a course
 If a construction worker or supervisory employee fails to present his or her employer with a current and valid completion card for an OSHA-10 or 30 hour course not later than 15 days after being hired, the employer shall suspend or terminate his or her employment.
All classes must be taught by a trainer authorized to do so by the Occupational Safety and Health Administration of the United States Department of Labor.
